Maintenance Contract
5. Periods of time
If you doubt the period dates of this contract use the date on post stamps.
6. Liability restriction
The contractor and the manufacturer of the solar installation are liable to the principal or
third emerging person, material or other financial damages only, if it is from the
Contractor or the manufacturer at least grossly negligence was caused. The substitute
is impossible in every case from indirect damages and consequence damages.
7. Guarantee for maintenance
There is no warrant claims by the principal of the maintenance service over the term
of the maintenance contract.
8. Prohibited right transfer
The principal is not eligible to supplement rights from this contract without the transfer of
prior written consent of the contractors to a third party.
9. Natural disaster
The contractor and the principal are fulfilling contractual duties to deliver as long
as it is impossible through the natural disaster. Also is regarded a disaster if the delay of
delivery by sub contractors is caused by a natural disaster.
10. Data protection
The contractor help the principals to protect measurement data according to the data
protection act and its rules.
11. Confidentiality
All data that is put to the disposal by one of the parties of the contract, or from their co-operation,
the secret is closely kept provided a party to the contract doesn't give up the secrecy.
12. End provisions
12.1 The contract, the alterations and supplements need their effectiveness of a written form;
Supplements and alterations must also have the serial number of this contract. They will
regard this as part of original contract.
12.2 If a provision of this contract should be declared ineffective, other provisions are valid.
At the place of the ineffective provisions, an economic result that correspond is placed.
The substitute provision is an alteration of contract in accordance with 12.1
12.3 This contract and all its sections fall under German right ; For disputes it will arrange
for a judge in D - 56070 Koblenz.
